The Owners - Strata Plan No 74602 v Brookfield Australia Investments Ltd
The Supreme Court NSW Proceedings concerned a residential development known as "Beau Monde" in North Sydney. Levels 9 to 36 of the building comprise 241 strata apartments. In 2012 the Owners Strata Plan commenced legal proceedings against the builder, claiming damages for breach of contract and of the statutory warranties in section 18B of the Home Building Act 1989 and at common law. Among others the claims included alleged fire-safety defects.
Stephen Grubits & Associates were engaged by the Defendant to provide an Expert Witness in the proceedings. The evidence submitted by SGA substantiated the adequacy of much of the installed fire-safety systems. As a result, a claim that amounted to over 2 million dollars was reduced to less than 4 % of the original sum.
